IN NO EVENT SHALL EAST COAST WINGS'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES EXCEED THE GREATER OF: (A) THE AMOUNT PAID BY YOU TO EAST COAST WINGS IN THE THREE (3) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED UNITED STATES DOLLARS ($100.00).

The limitation of liability set forth above is a fundamental element of the basis of the bargain between East Coast Wings and you. Some states do not allow the exclusion or limitation of liability for certain types of damages, so the above limitations may not apply to you to the extent prohibited by applicable law.

12. Dispute Resolution

12.1 Informal Resolution

Before initiating any formal legal proceeding, you agree to attempt to resolve any dispute, claim, or controversy arising out of or relating to these Terms or our Services informally by contacting East Coast Wings at [email protected]. We will make good-faith efforts to resolve the matter within thirty (30) days of receiving your written notice describing the nature of the dispute and your desired resolution.

12.2 Binding Arbitration

If the dispute cannot be resolved through informal negotiation within thirty (30) days, you and East Coast Wings agree to resolve the dispute through binding arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association (AAA), except as modified herein. The arbitration shall be conducted in the United States, in the state where East Coast Wings's principal place of business is located, unless otherwise agreed by both parties in writing.

The arbitrator shall have the authority to award any remedy that would be available in a court of law. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

You and East Coast Wings each waive any right to a jury trial.

12.3 Class Action Waiver

YOU AND EAST COAST WINGS AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, REPRESENTATIVE, OR COLLECTIVE ACTION. Unless both you and East Coast Wings agree otherwise, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding.

12.4 Exceptions to Arbitration

Notwithstanding the foregoing, either party may seek emergency injunctive or equitable relief from a court of competent jurisdiction to prevent actual or threatened infringement of intellectual property rights or to protect confidential information, pending the completion of arbitration.

13. Term and Termination

These Terms of Service shall remain in full force and effect for as long as you use our Website or Services. We reserve the right, in our sole discretion and without notice or liability, to:

In such circumstances, our obligations under these Terms shall be suspended for the duration of the force majeure event.

Our Website and Services are not directed to children under the age of thirteen (13). We do not knowingly collect personal information from children under 13.
